This is Atlantic City Mayor’s Last, Best Chance to Avoid Prison [Opinion]
On Friday, March 14, 2025, Atlantic City, New Jersey Mayor Marty Small … along with his wife, La’Quetta Small will be appearing before New Jersey Superior Court Judge Bernard DeLury.
The evidence against The Smalls’ is so compelling and voluminous, that their last, best chance to avoid conviction and a prison sentence is to try and have a subpoena quashed and evidence suppressed.
It’s going to be a very heavy lift, as we have already had a preview of the likely result.
Constance Days-Chapman, the suspended Atlantic City High School Principal already attempted and failed to do the same thing.
Days-Chapman is currently fighting for her freedom and her educational teaching and supervisors certificates.
An Atlantic County Grand Jury indicted Days-Chapman on August 17, 2024 on a variety of criminal counts as follows:
- second-degree Official
Misconduct. - one count of second-degree Pattern of Official Misconduct.
- one count of second-degree Endangering the Welfare of a Child.
- one count of third-degree Hindering
Apprehension of Another.
Days-Chapman attempted the same legal move that the Smalls’ are trying to.
Judge DeLury didn’t buy it and the subpoenas and evidence will not be quashed and suppressed.
It’s hard to imagine that Marty and La’Quetta Small will have any better luck before Judge DeLury, as the Atlantic County Prosecutor’s Office handled the Smalls’ and Days-Chapman in the same manner.
The Atlantic County Prosecutor’s Office previously released the following statement about Marty and La’Quetta Small.
On Tuesday, September 17, 2024, Marty
Marty Small, Sr., 50, and his wife, La Quetta Small, 47, of Atlantic City, NJ were both indicted for second-degree Endangering the Welfare of a Child. Marty Small, Sr. was also indicted for third-degree Terroristic Threats, and third-degree Aggravated Assault. It is alleged that during the months of December 2023 and January 2024, the defendants physically and emotionally abused their 15/16-year-old-daughter on multiple occasions. During one incident, on January 13, 2024, Marty Small, Sr. is alleged to have hit his daughter multiple times in the head with a broom causing her to lose consciousness, said the Atlantic County Prosecutor’s Office.
Additionally, Marty Small was separately indicted for witness tampering by a second Atlantic County jury.
